1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Twecho ("Company," "we," "our," or "us") regarding your use of our communication platform and services.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

2. Description of Services

Twecho provides cloud-based communication services including:

• SMS and MMS messaging APIs
• Voice calling and conferencing APIs
• Phone number provisioning and management
• SIP trunking services
• Number lookup and validation services
• Developer tools and documentation

We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice.

3. Account Registration and Security

Account Requirements

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining account security
• You may not share your account credentials

Account Responsibility

You are fully responsible for all activities that occur under your account, including:

• All charges incurred through your account
• Compliance with our Acceptable Use Policy
• Maintaining the confidentiality of API keys
• Notifying us immediately of any security breaches

4. Payment Terms

Billing and Payment

• Charges are billed monthly based on usage and plan selection
• Payment is due within 30 days of invoice date
• We accept major credit cards and ACH transfers
• All prices are in US dollars unless otherwise specified

Late Payments and Suspension

• Late payments may incur additional charges
• Services may be suspended for non-payment
• We reserve the right to terminate accounts for repeated non-payment

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM
• WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE
• YOU ACKNOWLEDGE THAT INTERNET AND MOBILE NETWORKS ARE INHERENTLY UNRELIABLE

6. Termination

Termination by You

• You may terminate your account at any time through your account settings
• You remain responsible for all charges incurred prior to termination
• Some provisions of these Terms survive termination

Termination by Us

We may suspend or terminate your account immediately for:

• Violation of these Terms or our Acceptable Use Policy
• Non-payment of fees
• Suspected fraudulent or illegal activity
• Risk to our services or other customers

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in New York County, New York.
